About These Terms
These Terms govern your access to Beyt.co, our mobile applications, and related property-search, listing, account, referral, and support services (together, the “Services”). “Beyt”, “we”, “us”, and “our” refer to the operator of the Services in the State of Kuwait. “User” means any visitor, property seeker, owner, landlord, agent, advertiser, or account holder. “Listing” means a property advertisement, and “Content” includes text, photographs, documents, messages, reviews, and other material made available through the Services.
Accepting These Terms
By accessing the Services, creating an account, publishing a Listing, or selecting a button that indicates acceptance, you agree to these Terms and our Privacy Policy. Electronic acceptance may have legal effect under Kuwait Law No. 20 of 2014 concerning Electronic Transactions. If you do not agree, do not use the Services. If you use Beyt for a company or another person, you confirm that you have authority to bind them.
Eligibility and Accounts
You must be at least 18 years old and legally capable of entering a binding agreement. You must provide accurate, current information and keep it updated. You are responsible for protecting your password, verification codes, and devices and for activity under your account. Tell us promptly at support@beyt.co if you suspect unauthorized access. We may request reasonable identity, ownership, authority, or professional-license information before allowing certain features.
Beyt’s Role as a Marketplace
Beyt provides technology that helps users discover, advertise, and communicate about property. Unless we expressly agree otherwise in a separate written agreement, Beyt is not a real-estate broker, agent, valuer, legal adviser, escrow provider, owner, buyer, landlord, or party to any property transaction. We do not negotiate or conclude a sale, lease, or exchange for users. Search ranking, featured placement, account checks, or a verification badge do not amount to a guarantee of a Listing, a User, title, permits, condition, valuation, or transaction.
Listing Rules and Advertiser Responsibilities
You may publish a Listing only if you own the property or are lawfully authorized to advertise it. Listings must be accurate, current, lawful, and not misleading. Prices, availability, location, property type, area, photographs, and material conditions must be stated honestly. You must promptly update or remove a Listing when it is unavailable. Agents and other professionals are responsible for holding every licence or authorization required in Kuwait and for identifying their professional capacity accurately. Do not publish duplicate, bait, fictitious, discriminatory, or fraudulent Listings.
Property Enquiries and Transactions
Users communicate and transact at their own discretion and risk. Before paying money, signing documents, or sharing sensitive information, independently verify the other party’s identity and authority, the property title and condition, applicable licences and approvals, the agreed price, and the legal effect of the documents. Obtain appropriate legal, technical, and financial advice. Beyt is not responsible for deposits, rent, sale proceeds, brokerage commissions, or agreements exchanged directly between Users. Report suspicious Listings or conduct to support@beyt.co and, where appropriate, to the competent Kuwait authorities.
Credits, Featured Listings, and Paid Features
Beyt may offer credits, featured placement, subscriptions, or other paid or promotional features. The price, duration, benefit, eligibility, and any specific conditions shown before activation form part of these Terms. Credits are a limited right to use eligible Beyt features; they are not money, have no cash value, and may not be transferred or sold unless we expressly permit it. A featured placement improves presentation or visibility but does not guarantee enquiries or a transaction. Refunds, cancellations, and expiry are governed by the terms shown at purchase and any mandatory rights under Kuwait consumer-protection law.
Your Content and Licence to Beyt
You retain ownership of Content you submit. You grant Beyt a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, translate, display, distribute, and promote that Content only as reasonably needed to operate, improve, secure, and market the Services and your Listing. This licence ends when the Content is deleted, except for reasonable backup, legal, fraud-prevention, and previously shared promotional copies. You confirm that you have all rights and permissions needed for the Content, including photographs and personal information relating to others.
Acceptable Use
You must not use the Services to break Kuwait law or another applicable law; commit fraud, impersonation, harassment, threats, defamation, or infringement; access an account or system without authorization; upload malware or harmful code; interfere with security or availability; collect personal data without a lawful basis; scrape, crawl, reverse engineer, or use automated tools except with our written permission; manipulate rankings or metrics; send spam; or use Listing information for an unrelated commercial database. Conduct involving unlawful access, electronic fraud, threats, interception, or misuse of payment data may also fall within Kuwait Law No. 63 of 2015 concerning Combating Information Technology Crimes.
Review, Moderation, and Cooperation
We may review, reject, limit, correct the format of, suspend, or remove Content or accounts where we reasonably believe these Terms, our policies, another person’s rights, or applicable law may have been breached. We may preserve relevant records and cooperate with courts, regulators, law-enforcement bodies, and other competent authorities when legally required. Moderation is risk-based and does not mean that Beyt has inspected or approved every Listing.
Beyt Intellectual Property
The Services, including Beyt’s name, logos, design, software, databases, selection and arrangement of content, and original materials, are owned by or licensed to Beyt and protected by applicable intellectual-property laws. Subject to these Terms, we give you a limited, revocable, non-transferable right to use the Services for their intended personal or internal-business purpose. No other right is granted.
Third-Party Services and External Communication
The Services may link to maps, messaging platforms, social networks, payment services, app stores, or other third parties. Calls, WhatsApp messages, payments, and other activity that takes place outside Beyt are governed by the third party’s terms and privacy practices. We do not control and are not responsible for those services, but this does not limit any responsibility that cannot lawfully be excluded.
Availability and Changes to the Services
We aim to keep Beyt available and useful, but the Services may occasionally be interrupted for maintenance, security, technical, legal, or operational reasons. Features, search results, eligibility rules, and promotional programmes may change. Where practical, we will give reasonable notice of a material change that adversely affects a paid feature already purchased.
Disclaimers and Limits of Responsibility
To the extent permitted by Kuwait law, the Services are provided on an “as available” basis. User Content and Listings come from Users, and Beyt does not warrant that they are complete, accurate, available, lawful, or suitable for a particular transaction. Beyt is not liable for a User’s conduct or for indirect or consequential loss that was not reasonably foreseeable. Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, or any liability or mandatory consumer right that cannot be excluded under Kuwait law, including applicable rights under Law No. 39 of 2014 concerning Consumer Protection.
Responsibility for Your Breach
To the extent permitted by law, you are responsible for losses, claims, and reasonable costs suffered by Beyt because of your unlawful Content, your infringement of another person’s rights, your misuse of the Services, or your material breach of these Terms. We will give you reasonable notice of a third-party claim where practicable. This clause does not make a consumer responsible for matters caused by Beyt or remove any mandatory legal protection.
Privacy and Electronic Communications
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal data. Service messages may be sent electronically to the email address, phone number, device, or account you provide. Marketing messages will be sent in accordance with applicable requirements and may be stopped through the unsubscribe method provided or by contacting us.
Suspension and Termination
You may stop using Beyt at any time and may request account closure. We may restrict, suspend, or terminate access where reasonably necessary to protect Users or the Services, investigate suspected misconduct, comply with law, respond to prolonged inactivity, or address a material or repeated breach. Where appropriate and lawful, we will explain the action or give an opportunity to correct the issue. Provisions that by their nature should continue—including intellectual property, liability, disputes, and records needed by law—survive termination.
Changes to These Terms
We may update these Terms to reflect changes in the Services, law, security, or business operations. We will publish the revised Terms and update the Effective Date. If a change materially affects registered Users, we will provide reasonable notice through the Services or registered contact details where practicable. Continued use after the effective date means you accept the revised Terms; if you do not accept them, you should stop using the Services.
Kuwait Law and Disputes
These Terms are governed by the laws of the State of Kuwait, including, where applicable, Kuwait Law No. 20 of 2014 concerning Electronic Transactions, Law No. 63 of 2015 concerning Combating Information Technology Crimes, and Law No. 39 of 2014 concerning Consumer Protection, each as amended. The courts of Kuwait have jurisdiction over disputes, without prejudice to any mandatory right to approach a competent regulator, consumer-protection body, or another forum available under applicable law. Please contact us first so we can try to resolve the matter promptly.
English and Arabic Versions
These Terms are available in English and Arabic for accessibility. Both versions are intended to express the same rules. If there is an inconsistency, the Arabic version will prevail to the extent permitted by applicable law.
